Maryland sexual assault laws

Maryland law categorizes the crime of rape, which is a sex crime that includes penetration, and sexual offenses, which involve sexual contact. What would be called sexual assault in another state is referred to in Maryland law as rape in the first degree.

Aggravated sexual assault involves a sex crime that is either rape or sexual offense, but which also includes certain aggravating factors. The crime of rape is forced vaginal intercourse or a sexual act without consent. Aggravating factors might include the use or display of a deadly weapon, the suffocation, strangling, disfiguring, or infliction of serious physical injury, threatening the victim, or placing the victim in fear that someone close to him or her will be harmed if he or she does not comply. Other aggravating factors include if the sex crime is committed by two or more people acting together, if the crime is connected to a burglary, the age of the victim, if the perpetrator is under age 18, and the difference in ages between the victim and perpetrator.
