Maryland sex crimes and the consequences

Sex offenses cover a range of elements and degrees within Maryland criminal statutes. The following are examples of sex crimes in Maryland:

  • Rape, sexual assault, and aggravated sexual assault. These charges are defined by Maryland law as vaginal intercourse by force, and/or the threat of force without the consent of the other party. Rape can involve the use of or threatened use of a dangerous weapon. Rape in the second degree is committed against a person who is mentally deficient or physically helpless. The possible penalties for rape include the mandatory minimum of 25 years to life without parole.
  • Sexual offense in the First degree. This felony offense involves engaging in a sexual act not involving penetration using force, or the threat of force without the consent of the other party. Attempted first degree sexual offense is also a felony. Penalties for sexual offense in the first degree include mandatory minimums of not less than 25 years.
  • Sexual offense in the Second Degree. Those who are charged with a sexual offense in the second degree have been accused of engaging in a sexual act with an individual who has mental deficiencies, or who is mentally incapacitated, or physically helpless and the perpetrator knows that the victim is mentally deficient or physically helpless. The mandatory minimum sentence for second-degree sexual assault is not less than 15 years.
  • Sexual offense in the Third degree. This felony sexual offense involves a non-consensual sexual act by force through the use of a deadly weapon, an object that the victim believes is a deadly weapon, and suffocation, strangling, disfiguring, or inflicting serious physical injury while committing the crime. For convictions of third-degree sexual offense, the mandatory minimum sentence is 10 years.
  • Sexual offense in the Fourth Degree. This offense which includes forced, non-consensual sexual act is perpetrated by a “person in a position of authority,” who is over 21 years old, employed at a public or private elementary or secondary school and exercises supervision over minors who attend the school. An individual convicted of a sexual offense in the fourth degree could face three years in prison, and a $1,000 fine.

The Registry has three tiers which correspond with the different periods a person’s name appears on it: Tier one is for those convicted of a fourth-degree sexual offense, and it requires them to remain on the Registry, and check in every 6 months for 15 years. Tier two is for third-degree sexual offenses and requires registration every 6 months for 25 years. Tier three offenses, which are the most violent, require convicted offenders to register every 3 months for the rest of their lives.
